Terms of Service

These Terms govern your use of the Bargain Bay website and your purchases from us. Bargain Bay is operated by RS Solutions ("we," "us," "our"). By using the site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

1. Eligibility

You must be the age of majority in your province and able to enter a binding contract to purchase from us.

2. Our products

We sell overstock, open-box, refurbished, and scratch-and-dent appliances. Each unit is bench-tested and its condition is described on the product page. Most items are one-of-a-kind (single quantity), and cosmetic imperfections may exist — this is normal for liquidation goods. Product photos may be representative; please rely on each listing's condition notes.

3. Pricing, availability & errors

Prices are in Canadian dollars and exclude taxes and delivery unless stated otherwise. Because units are unique and inventory moves quickly, an item may sell out between your visit and checkout. We may correct pricing or description errors and cancel and refund affected orders.

4. Orders & acceptance

Your order is an offer to purchase. We may accept or decline any order, limit quantities, or cancel and refund an order (for example, if an item is unavailable, mispriced, or we suspect fraud). An order confirmation email acknowledges receipt but does not constitute acceptance until the item is ready for pickup or shipment.

5. Payment & taxes

Payment is processed securely by Stripe. Applicable HST (13% in Ontario) is calculated and added at checkout.

6. Pickup, delivery & freight

Free pickup is available at our Lynden warehouse by appointment. Local delivery and freight are offered at the rates shown at checkout. Title and risk of loss pass to you upon pickup, or upon delivery to your address. Please ensure clear access and that the appliance fits your space and doorways; missed or failed deliveries may incur a re-delivery fee.

7. Condition, warranty & returns

Items are sold in the condition described, and include a one-year functional warranty. Returns are handled per our Returns & Refund Policy. Except as set out in those documents and as required by law, items are sold "as-is" with respect to cosmetic condition.

8. Acceptable use & intellectual property

Don't misuse the site — no scraping, interference, or unlawful or infringing activity. Site content, logos, and images are owned by us or our suppliers and may not be copied or reused without permission.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to a product or the site is limited to the amount you paid for the item in question, and we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits any liability that cannot be excluded by law, including your rights under the Ontario Consumer Protection Act.

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the site or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and disputes are subject to the courts of Ontario.

12. Changes to these Terms

We may update these Terms from time to time. Your continued use of the site after changes are posted means you accept the updated Terms.
